Terms of Service

Effective as of 11th July 2025

These Terms of Service (“Terms”) govern your use of services provided by Qumans Private Limited, an Indian company registered under the Companies Act, 2013, with its registered office in India (“Qumans”, “we”, “our”, or “us”).

By signing up for our services or engaging with our team, you (“Client”, “you”) agree to be bound by these Terms.

Scope of Service

Qumans provides professional, manual QA services using skilled human testers (“Testers”) who work full-time under our employment. We assign testers to your account who integrate with your team and test your product based on resources you provide (e.g., documentation, staging links, accounts).

Testers work on weekdays, full-time, unless otherwise agreed.

Onboarding and Access

We begin work within 24 hours of signup, subject to receipt of payment and necessary project access (e.g., staging URLs, logins, docs).
You are responsible for ensuring appropriate test environments and safe access to production or staging systems.

We do not store your product data, credentials, or IP in any Qumans system. All testing is conducted in the environments you provide.

Client Communication & Tester Anonymity

You may communicate directly with your assigned Tester(s), however, we do not disclose the personal identity or direct contact details of any team member.

Non-Solicitation

You agree not to solicit, hire, or attempt to engage any Qumans employee, contractor, or representative — directly or indirectly — during the term of our engagement and for 12 months after it ends.

Likewise, Qumans agrees not to solicit or recruit your employees or contractors during or after the engagement.

All Qumans employees sign binding full-time agreements that include strict non-solicitation clauses. Any breach by an employee may result in termination of employment and/or personal fines, per their contract

Any attempt to bypass, solicit, or engage Qumans staff outside of this agreement must be reported to us immediately. Our employees are also required to report any client-initiated solicitation attempts without delay.

A breach of this clause — by either party — will result in a liquidated damages penalty of £20,000 GBP per incident, payable within 30 days of breach notification.

Billing, Payment & Cancellations

  • All plans are billed monthly in advance through Razorpay (or other approved methods).

  • There are no refunds for any payments made.

  • Either party may terminate the engagement with 14 days’ written notice. Services will continue during the notice period.

Intellectual Property (IP)

All intellectual property, product data, or proprietary information you share remains solely yours. Any test reports, bug findings, or documentation created by our team during your engagement will be licensed to you for your use.

Qumans does not claim ownership of your product, platform, brand, or any related IP.

Confidentiality & Data Protection

We treat your data, platforms, credentials, and information with strict confidentiality.
All our employees and contractors are under binding NDAs covering:

  • Non-disclosure of any client materials

  • No external sharing of any screenshots, data, credentials, or internal knowledge

  • Immediate deletion of any temporary access upon termination

We do not internally store or retain any client files, credentials, or platform data.

Limitation of Liability

While we strive for excellence, we do not guarantee that all bugs will be found or that no issues will reach production.
You agree that Qumans will not be liable for any indirect, incidental, consequential, or financial loss, including loss of business, revenue, or reputation, arising from the use of our services — even if advised of such risk.

Our total aggregate liability under these Terms is limited to the fees you paid in the 30 days prior to any claim.

You agree to indemnify and hold harmless Qumans and its team from any claims, damages, or losses related to your use of our services.

Fair Use & Acceptable Conduct

You agree not to use our services for any unlawful purposes or in violation of any applicable laws or regulations. We reserve the right to suspend service in the case of abuse, fraud, or misuse.

Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gurugram, India.

Modifications

We may update these Terms from time to time. Material changes will be notified on our website or via email. Continued use of our services after such changes constitutes acceptance.
